Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the Kaal application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Kaal (“Company”, “we”, “us”, or “our”).
2. Eligibility
You must be at least 13 years of age to use this App. By creating an account or using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Account Registration
You may create an account using your email address or third-party sign-in (Google, Apple, Microsoft). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use at r.official@jumbarthi.com.
4. Subscriptions & In-App Purchases
Kaal offers a free tier and a premium subscription (“Kaal Pro”), billed through the Apple App Store or Google Play Store. Prices are displayed at checkout. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged within 24 hours prior to renewal. You can manage or cancel anytime in your device’s App Store or Play Store account settings. No refunds are issued for unused portions of a period unless required by applicable law.
5. Free Trial
Where offered, a free trial of Kaal Pro automatically converts to a paid subscription at the end of the trial unless cancelled beforehand. You will not be charged during the trial period.
6. Restore Purchase
To restore a previous Kaal Pro purchase on a new device, go to Profile → Edit profile → Restore purchase. Restore is only available for purchases made through the same App Store or Play Store account.
7. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App, nor reverse engineer or attempt to extract its source code.
8. User Content
You retain ownership of all tasks, notes, goals, and other content you create (“User Content”). By using the App, you grant us a limited license to process and store your User Content solely to provide the App’s features. We claim no ownership over your User Content.
9. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to gain unauthorized access to any portion of the App or its systems.
- Transmit any viruses, malware, or other harmful code.
- Impersonate any person or entity.
- Use automated means to scrape or collect data from the App.
- Violate any applicable local, state, national, or international law.
10. Termination
We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties. You may delete your account at any time in Profile → Edit profile → Delete account.
11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAAL OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
13. Governing Law
These Terms are governed by the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, India.
14. Changes to Terms
We may update these Terms from time to time and will notify you of material changes via in-app notification or email. Continued use of the App after changes constitutes acceptance of the new Terms.
